All the trespassing charges have been dropped against the so called ”Caledonia8.”
Gary McHale and seven others had their charges thrown out in a Cayuga courtroom this afternoon.
They were arrested back in December after being accused of trespassing on the Douglas Creek Estates while holding a protest.
McHale preached he never trespassed; he was just standing on a County Road.
McHale tells CD989 he plans to protest the DCE again on February 18th.

Lol. Oh, Gary. Since the charges were dropped he now has grounds to sue the Opp for wrongful arrest. And he will probably do it again. We get the statement he is trying to make and Im sure he’ll get a settlement out of it.
How many times does a person have to get arrested and then have the charges dropped before he can then sue for harrassment? Lots of officials here sitting on the fence and afraid to make a decision.
If Gary was wrong in what he is doing then he would have been in the slammer a long time ago.
Somebody in federal and provincial government really does not want this issue to stay on the front pages.

This was for the protest in December. He was released 20 minutes after his last arrest. They know they have nothing on him. Which is the point!
Is this the only guy the OPP aren’t afraid of ? Was he loitering at Tim Horton”s?
Evidence was introduced in court that McHale and the other 7 individuals charged were on public property and not the disputed Douglas Estates. If that were the case in the first place why did the OPP arrest them?
I look forward to remedial map reading training that Caledonia OPP will be required to take. This whole event is a persecution not prosecution in the public interest. The government and police are acting as bullies, abusing the law for their own end. It creates disrespect for the law everywhere.
He was not in the wrong by being there that’s why the charges were dropped. However, the O P P had to arrest him for public safety. If they had allowed him to stay, the Indians would be out. Blocking the road perhaps or fighting. The O P P has been instructed to simply keep the peace or keep the Indians happy.
this would be about the only time i could support someone for bringing charges against someone (lawsuit) !

Tough to express an opinion on this subject.Seems that just when a good discussion starts the ability to post on the subject ends.
How many more times will McHale be charged, only to have those charges thrown out for legitimate reasons? The Province and OPP are gift wrapping an unlawful arrest lawsuit for McHale. But hey, it’s easier to focus on McHale than the real issue of illegal land occupations. It’s the McGuinty way. Coward.
